Any employer operating in CA or intending to hire a CA resident would be well advised to work only with a background check company whom fully understands and implements all of the CA requirements that go beyond the Fair Credit Reporting Act. While federal law usually overrides state law, in the the case of the FCRA the CA version is more restrictive, thus it is the CA law that prevails. These companies are known as “data brokers” and they claim to be able to tell you about California criminal records and many other types of information, but in reality they show more disclaimers about what they cannot do than actual information that they provide. These companies usually have a low price, offer instant answers and do not have a telephone number for you to call to speak with someone. They cannot, and do not, provide you with any actual human review of the information they are selling you. Further, many are not legitimately operating businesses and most likely they are not licensed private investigators. Just where is all of your confidential information being sent, and to whom?

It is illegal in CA to base employment suitability solely on the results from a database record search. The most effective and accurate way to retrieve criminal court records in CA is from an onsite physical record inspection at the county courthouse. Don’t be fooled that some database records are FCRA or California compliant for primary hiring decisions when adverse information is identified--they aren’t, and you’ll get the proof when you’re in court being sued!
