California Compliant Employment Background Checks

CA background screening checkThe laws regarding pre-employment background checks and screening in California are more strict than any other state. Any employer operating in CA or intending to hire a CA resident would be well advised to work only with a background check company whom fully understands and implements all of the CA requirements that go beyond the Fair Credit Reporting Act. While federal law usually overrides state law, in the the case of the FCRA the CA version is more restrictive, thus it is the CA law that prevails. Failure to follow CA background check laws will result in a violation of the civil rights of the applicant. These lawsuits usually bring very large money settlements that could cripple any business.

A background check is a vague term that can consist of many types of searches from a multitude of different sources. Because many people have little or no experience hiring a firm to conduct a California background investigation, they are not familiar with what a firm like HireSafe can do for your business.

The CA background check laws are strongly written to favor the applicant and every employer should be very cautious in their use of criminal records for employment suitability. The age of the criminal record could be a vital issue, as CA restricts their use to the previous seven years. Certain marijuana possession convictions are not reportable and neither are arrests not leading to a conviction. A careful physical examination of a criminal record is required because it may be a reportable record, and then again, it may not be. Only an experienced CA Investigator will understand the nuances in reporting from the 58 county court jurisdictions located in California. Each of the CA courts operate a little differently and our experienced researches know the clerks and how to get the reliable and accurate records that you need.

Unfortunately, with the many types of records available and a general lack of understanding about our research capabilities, many websites have been established that sell background checks which are absolutely worthless for their clients. These companies are known as “data brokers” and they claim to be able to tell you about California criminal records and many other types of information, but in reality they show more disclaimers about what they cannot do than actual information that they provide. These companies usually have a low price, offer instant answers and do not have a telephone number for you to call to speak with someone. They cannot, and do not, provide you with any actual human review of the information they are selling you. Further, many are not legitimately operating businesses and most likely they are not licensed private investigators. Just where is all of your confidential information being sent, and to whom?

There is NO statewide database of criminal records in California that contains all 58 counties. At best, 18 counties provide some format of criminal record data from various levels of reporting criteria. It is illegal in CA to base employment suitability solely on the results from a database record search. The most effective and accurate way to retrieve criminal court records in CA is from an onsite physical record inspection at the county courthouse. Don’t be fooled that some database records are FCRA or California compliant for primary hiring decisions when adverse information is identified--they aren’t, and you’ll get the proof when you’re in court being sued!
