While federal law usually overrides state law, in the the case of the FCRA the CA version is more restrictive, thus it is the CA law that prevails. These companies are known as “data brokers” and they claim to be able to tell you about California criminal records and many other types of information, but in reality they show more disclaimers about what they cannot do than actual information that they provide. The most effective and accurate way to retrieve criminal court records in CA is from an onsite physical record inspection at the county courthouse. Don’t be fooled that some database records are FCRA or California compliant for primary hiring decisions when adverse information is identified--they aren’t, and you’ll get the proof when you’re in court being sued!
